Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the websites, software, and services provided by NewNormal Security (“NewNormal Security,” “we,” “us,” or “our”), including the NewScan scanner and the optional, paid NewScan Pro upgrade (together, the “Services”). By downloading, installing, accessing, or using the Services, or by purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

NewScan is a free, self-hosted security scanner that you download and run on your own machine. Local scanning is free to use; you bring your own AI provider key (BYOK) if you choose to enable AI features. NewScan runs under your control, and your target traffic, findings, and any AI keys remain on your machine.

NewScan Pro is an optional, paid upgrade. It provides a NewNormal-hosted out-of-band (OOB) listener that receives HTTP(S) and DNS callbacks from your authorized targets so that blind and reflection-based vulnerabilities can be confirmed. Pro is strictly opt-in and is not required to run a complete scan; the scanner remains fully functional without it.

2. License to use NewScan

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use NewScan for your internal business or professional use. A paid NewScan Pro subscription grants you a license to access the hosted OOB service for the subscription term, registered to your email address and bound to your activated device(s) (up to the device limit shown at purchase). You may not resell, sublicense, redistribute, or share license keys, or circumvent license or device limits.

3. Authorized use only

Security testing tools can cause disruption and may be unlawful if used without authorization. You agree that you will:

• only scan systems, networks, applications, and assets that you own or are expressly authorized in writing to test;
• comply with all applicable laws, regulations, and third-party terms;
• be solely responsible for obtaining all necessary permissions and for the consequences of your scans, including any impact on tested systems; and
• not use the Services for any unlawful, harmful, or abusive purpose.

You are responsible for configuring scope correctly. We are not responsible for any damage, disruption, data loss, or liability arising from your use of the Services against any system.

4. Orders, billing, and payments

When you purchase NewScan Pro, your payment is processed by Stripe and is subject to Stripe’s Privacy Policy. Prices are stated in U.S. dollars unless otherwise shown at checkout and are exclusive of any applicable sales tax or VAT, which is added at checkout where required and collected and remitted by NewNormal Security. We currently offer:

• Monthly — $495 per month, billed monthly, no commitment;
• Annual commitment — $200 per month billed monthly on a fixed 12-month term ($2,400 total over the year). This is a one-year commitment, not a month-to-month plan, and cannot be cancelled mid-term (see §5);
• Annual — $1,985 per year, paid up front; and
• Month-to-year upgrade — $1,690 one-time to convert an active monthly subscription to a full annual term.

5. Subscriptions, renewals, and cancellation

NewScan Pro is sold as a recurring subscription that automatically renews at the then-current price at the end of each billing period until cancelled. For the monthly plan you may cancel at any time by contacting us at support@newnormalsecurity.com; your access continues until the end of the paid period, after which it ends and the scanner reverts to its free local behavior.

The annual-commitment plan ($200/month) is a fixed 12-month term: the twelve monthly payments are a single one-year commitment and the plan cannot be cancelled for a refund mid-term. You may turn off auto-renewal so it does not continue past the 12 months, but the committed term itself runs to completion.

Cancellation of future renewals does not, by itself, entitle you to a refund of amounts already paid except as set out in our Refund Policy.

6. Refunds

Refunds are governed by our Refund Policy and are handled directly by NewNormal Security. Please read it before purchasing.

7. Acceptable content and conduct

You may not use the Services to violate the rights of others, to access systems without authorization, to distribute malware, or in any manner inconsistent with these Terms or applicable law. We may suspend or terminate access for violations of these Terms.

8. Intellectual property

The Services, including NewScan, NewScan Pro, the website, and all related content and trademarks, are owned by NewNormal Security or its licensors and are protected by intellectual-property laws. Except for the licenses expressly granted here, no rights are transferred to you.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will detect every vulnerability, be error-free or uninterrupted, or that scanning will not affect tested systems. Security testing is inherently risky and is performed at your own discretion and risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL NEWNORMAL SECURITY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless NewNormal Security from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your scanning of any system, or your violation of these Terms or applicable law.

12. Privacy

Our handling of personal data is described in our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, subject to any non-waivable rights you may have under the laws of your country of residence.
